This just in– the 9th Circuit Court has ruled AGAINST President Trump’s immigration order. Oh. And it was a unanimous decision.

“Rather than present evidence to explain the need for the Executive Order, the Government has taken the position that we must not review its decision at all. We disagree,” the panel wrote. “In short, although courts owe considerable deference to the President’s policy determinations with respect to immigration and national security, it is beyond question that the federal judiciary retains the authority to adjudicate constitutional challenges to executive action.”

Earlier this week, President Trump said his administration would take the case “through the system.” So, is he going to ask the Supreme Court to intervene? And would that even work? After all, a 4-4 decision is likely, meaning the lower court’s ruling would stand.
