Federal Judge Rules Against Trump’s Plan To Rescind The DACA Program

Who’s surprised by this? That’s right. NO ONE.

A federal judge out of San Francisco (of course) has ruled against the Trump administration’s plan to rescind the DACA program. If you recall, President Trump originally gave Congress 6 months to figure something out. However, U.S. District Judge William Alsup said the program must stay in place, even after Trump’s deadline passes.

Alsup ordered that until a final judgment is reached, the program must continue and those already approved for DACA protections and work permits must be allowed to renew them before they expire.

Dreamers who have never received DACA protections, however, will not be allowed to apply, Alsup ordered. Trump last year ended the Obama-era Deferred Action for Childhood Arrivals program. He gave Congress until March to find a fix.

The Department of Justice said in a statement that the ruling does not change the department’s position on the facts.

“DACA was implemented unilaterally after Congress declined to extend these benefits to this same group of illegal aliens. As such, it was an unlawful circumvention of Congress, and was susceptible to the same legal challenges that effectively ended DAPA,” the statement read.

If you recall, President Trump hosted a bipartisan meeting with lawmakers on DACA and immigration yesterday and allowed the press to watch. He made it clear that a wall MUST be part of the deal.

Some operate under the belief that Trump is caving to Democrats. The more I think about it, the more I believe that entire meeting was strategic. I was listening to my political sensei Rush Limbaugh today, and he basically said that people aren’t looking at the big picture. Why did Trump make the meeting public? Was it truly about fleshing out the immigration problem? Nope. It wasn’t just about that. It was to disprove the stories in Michael Wolff’s controversial book. Trump wanted to prove that it was a load, and by golly, it worked. MSM couldn’t believe that he opened up the meeting to the press. They couldn’t believe he looked competent and engaged. MSM actually praised him. (It only lasted 2 hours or so, but still. It happened.)

As Rush said:

Yet the Democrats in this meeting, it’s all about the DACA kids. They’re the only kids that exist! The Democrats are engaged in a love fest for the DACA kids. There’s another observation here. We’ve got the Michael Wolff book, and among its many assertions is that Trump is senile and he’s in the early stages of dementia, that he has no attention span, that he’s deluded and delusional. CNN and all the cable networks have just spent an hour televising Trump in total control of a meeting, with the Democrats in the meeting showing total deference and respect to Trump.

They’re not acting like they’re talking to an idiot who doesn’t know what he’s talking about. So this little televised meeting here is dispelling this idea that Trump is deranged and out of it and doesn’t know what he’s doing, is incompetent and unfit.

Rush’s take really made be feel better about the entire thing.

Right before the spot break ended, there was a… I couldn’t tell. I was looking at the back of this guy’s head, and I don’t know who it was, Republican or Democrat. I’m assuming Democrat because he was trying to tell Trump the wall wouldn’t work. He was saying (paraphrased exchange, “Look, I’ve talked to border agents, I’ve that worked to Border Patrol and asked them about the wall. They said the wall might delay people two hours.

“We don’t need to do the wall,” and Trump’s reply was, “Talk to Israel about that. Israel has had to build a wall and it’s worked like a charm.” So the Democrats, with the cameras on are pushing for a clean DACA bill with no end to chain migration and no funding for the wall. They’re asking for that, and then they want, after Trump agrees to that, if he does, comprehensive immigration reform to come after that. Let’s JIP this a little so you can hear for yourself what’s going on.

Some of you might be alarmed by this where Trump said, “Hey, I like everybody in this room and I can work with everybody in this room — and I know the people in this room can come up with the right thing to do.” Okay, so how does that get spun into something negative? I don’t know what Trump’s strategy here with this is, but I do know that he’s usually two or three moves ahead of people in the whole process of negotiation. He’s clearly trying to flatter them, not exclude them. He is making it very difficult for them to leave this meeting and for them to say he was unsupportive, that he was not open to their ideas, that he didn’t listen to them. They’re not gonna be able to say that.

They’re not gonna be able to say he was out of it. They’re not gonna be able to say that he didn’t know what was being discussed. Some in that room might try it. I mean, there’s some really left-wing radicals in that room, even though the cameras are rolling. Remember, the liberals get away with setting their own agenda and events, whether the cameras are there or not. They are not nearly held as accountable by the media as conservatives and Republicans are.

There are people I can tell you very worried on the pro-Trump side about this meeting. You’re shaking your head in there. Well, there are some. There are some Trump supporters who don’t like the way he did this meeting, and they don’t like the fact that he said he would do a DACA bill and then come back and do comprehensive. There are people that think Trump is getting rolled in this meeting and so forth. We’ll have to see. I am not of that frame of mind.

ANYWAY. The judge. He blocked Trump’s move, and Trump isn’t very happy about it.

It just shows everyone how broken and unfair our Court System is when the opposing side in a case (such as DACA) always runs to the 9th Circuit and almost always wins before being reversed by higher courts.
